Court Victory against Silverpoint Vacations, S.L. (2) May 15, 2017

The Article of 9.1.3 of law 42/98, requires that that all timeshare contracts have an end date that lasts no longer than 50 years. Because of this law another Silverpoint owner was able to have their contract null and void as there was no reference to its termination date.
The Court decided that no monies where to be returned because the contract is null and void, under the Spanish legal system, its as if the contract has never existed, so there can’t be any backdated monies.
The claim is currently on appeal as the clients are against the legal conclusion.
