Timeshare Cancellation

The Supreme Court in Spain has declared that any contract signed in perpetuity can now be considered as null and void. If you purchased your timeshare after the 5th of January 1999, you will be able to seek help with legitimately canceling your contract.

How Do I Qualify For A Contract Cancellation?

  • If you paid a deposit within the 14-day cooling off period
  • If you paid your balance within 90 days of the purchase date
  • If you were sold it as an investment
  • If your contract is in perpetuity or is over a 50-year period
  • If your contract contains Points or Floating weeks
  • The misrepresentation of the product when sold

When you purchase a timeshare, legally you have a 14 day "cooling off period" in which you can cancel your contract. You normally receive a warning at this point that after the cancellation period is over you cannot exit your timeshare due to being in perpetuity, however this is not true!
Even though there is a way that you can exit your timeshare, this is not a straightforward process. You cannot just send in a letter to the resort saying that you would like to cancel, or stop paying your maintenance fees, as you still have a signed contract which you are liable for.  
The exit process can be lengthy, complicated and most of the time expensive. Many people have tried to do it themselves and have failed. You will need help to be able to relinquish your timeshare contract, however the process doesn't have to be expensive or stressful. The Cancellation Process:

If you meet the criteria we will send you all our paperwork for you to review and sign. After our 14 days cooling off period we will start the timeshare exit process. You will then receive a call from one of our Legal Liaison Officers who will start to perform your cancellation case by going through a few questions with you regarding your timeshare purchase. Any paper work that you have will be needed for this process along with some specific details from your presentation. The reason we do this is so we can verify all potential areas of any timeshare misrepresentation. 

Each timeshare contract that we deal with is different, which means that every exit process is different also. Your Legal Liaison Officer will put together a detailed process that is individual to your contract, your resort and your case. You will also be told about the length of time needed for your case depending on the state and country your timeshare was purchased in as timeshare laws vary in different countries.
